Article 102: Role of the Constitutional Court

Chapter VIIIHigh

Constitution Text

“The Constitutional Court shall decide whether the laws and other acts of the Seimas are in conflict with the Constitution, and whether the acts of the President of the Republic and the Government are in conflict with the Constitution or laws. The status of the Constitutional Court and the procedure for the execution of its powers shall be established by the Law on the Constitutional Court of the Republic of Lithuania.”

Summary

The Constitutional Court decides whether laws and other acts of the Seimas conflict with the Constitution, and whether acts of the President and the Government conflict with the Constitution or laws. The Court's status and the procedure for exercising its powers are set by the Law on the Constitutional Court.

Key Points

  • •The Constitutional Court reviews whether laws and other acts of the Seimas conflict with the Constitution.
  • •Acts of the President and the Government are reviewed on two levels: against the Constitution or against laws.
  • •The Court's status and the procedure for exercising its powers are established by the Law on the Constitutional Court of the Republic of Lithuania.
  • •This article opens Chapter VIII, Constitutional Court (Articles 102 to 108).

Practical Example

If the Seimas passes a law that, for example, restricts the rights of a certain group, the Constitutional Court may rule that it conflicts with the Constitution, after which the law can no longer be applied. Such rulings regularly appear in Lithuanian news.

Exam Tips

Remember the distinction: acts of the Seimas are checked only against the Constitution, while acts of the President and the Government are checked against the Constitution or laws. The exam asks which institution decides whether a law conflicts with the Constitution.
